Abstract

This study examines the contemporary civilizational tension between Western sociopolitical thoughts and Islamic social frameworks, specifically focusing on the critical vacuum created by the uncritical adoption of Western ideals. Western civilization prioritizes absolute individualism, reducing society to a mere collection of atomized units, which manifests in hyper-liberal family structures, secular legal frameworks exemplified in Westernized personal laws, and individualistic human rights models. In contrast, this research explores the balanced sociological and jurisprudential paradigm of Averroes (1126-1198) as a vital alternative. By evaluating his views on the social structure, family dynamics, the socio-legal rights and duties of women including judicial and defensive roles within Shariah limits, and the protection of minorities, this paper highlights a harmonious synthesis between individual autonomy and collective responsibility. Furthermore, it incorporates traditional juristic insights, such as Imam Abu Hanifa’s concept of social justice regarding retribution, to counter contemporary Western models of global citizenship and citizenship laws deeply affected by Islamophobia. Utilizing a qualitative and analytical approach, this paper demonstrates how the purification of Western concepts and the reconstruction of Islamic thought can provide a robust, balanced model for modern Muslim societies, transitioning from blind imitation to genuine intellectual reconstruction.
