The Palestinian Issue and Human Rights: An Analytical Study in the Light of International Human Rights Law and Islamic Teachings

The Palestinian struggle is still a very deep and painful issue for people all over the world. It is like a wound that has not healed for a long time. It tells us a story of a people who have been gradually deprived of their very basic rights and freedoms. In this paper, we look closely at the Palestinian issue. The paper focuses on two main perspectives: the international human rights law on one hand and the Islamic law on human rights on the other hand. Besides, the paper also asks an important question: if international human rights instruments speak so beautifully about human dignity and the protection of civilians, then why do they always fail in practice when it comes to Gaza and the other occupied territories? In order to answer this question, the paper examines not only the legal texts such as the UN Charter, but also the ethical and spiritual sources of Islam, namely the Qur'an and the Sunnah. This paper presents a remarkable finding: both traditions law and religion call for respect of human life and the end of all forms of oppression; however, international law is often limited by political agendas and power struggles, whereas the Islamic tradition provides a clear and unwavering moral guidance that comes from God and entails a firm commitment to support the rights of the vulnerable. After a thorough comparative study, the paper suggests that the Palestinian issue cannot be handled effectively by continuing the policy of silence. Instead, the framework of accountability that is both consistent with the universal legal standards and with the deep-rooted moral and spiritual values should be developed and implemented.
