This study presents a research-based analysis of the juristic opinions of Imam Ibn al-Qayyim regarding the validity and legal implications of divorce (ṭalāq) pronounced during a woman’s menstruation. The issue of ṭalāq in the state of menstruation has long been a subject of اختلاف among classical Islamic jurists, with the majority of scholars considering it legally effective though sinful, while a minority—most notably Ibn al-Qayyim, following his teacher Ibn Taymiyyah—argue for its invalidity.
