A Research Study of the Powers of the Judiciary in the Light of the Qur’an and Sunnah

This study explores the concept, scope, and authority of the judiciary in Islam as derived from the Qur’an and the Sunnah. The Islamic judicial system is founded on the principles of justice, equality, and accountability, ensuring the protection of individual rights and the establishment of social harmony. The research highlights that the primary duty of the judiciary is to resolve disputes with fairness and impartiality while strictly adhering to divine guidance. Through an analytical examination of Qur’anic verses and Prophetic traditions, this study demonstrates that the judiciary in Islam possesses independent authority to administer justice, interpret legal matters, and implement laws without discrimination or external pressure. It also emphasizes the moral and ethical responsibilities of judges, including integrity, knowledge, wisdom, and fear of Allah. Furthermore, the study discusses the limitations of judicial power, stressing that judges must operate within the framework of Shariah and avoid personal bias or misuse of authority. The findings show that the Islamic concept of judiciary is not merely a legal institution but a moral system designed to ensure justice, protect human dignity, and maintain social order.
